SME Info Czechia Nr.2025-3: Changes in employment of foreigners in Czechia
From 1 October 2025, the rules for employing foreigners will change, as an amendment to the Employment Act introducing ‘undeclared work’ comes into force. Employers will be obliged to report the start of work of a foreigner before the actual start. Previously it was sufficient to do no later than on the day of starting work. Failure to comply will be considered an offence with sanction of up to CZK 3 million.
Key changes
- Obligation to report before starting work:
You must now report the start of a foreigner to the Labour Office no later than the day before he starts work.
- New institute of “undeclared work”:
Performance of work by a foreigner who has not been reported in advance to the Labour Office becomes an offence.
- High sanctions:
The employer faces a fine of up to CZK 3 million for undeclared work.
- Wide scope:
This change applies not only to third-country nationals with a work permit, but also to EU citizens.
What this means for employers?
- Early preparation:
Do not forget to report new foreign employees on time – at least 1 day before they start. - Digital reporting:
Reporting is done electronically, either by filling out an information card on the Labour Office website, sending an XML file to a data box, or by direct integration of your system.
